Purpose & Explanation

The Ohio Department of Transportation (ODOT) has a program that allows the LPA to administer projects that use federal funding vs. utilizing ODOT for this administration.  The process requires the LPA (the City of Hudson) to enter into an agreement with ODOT defining the LPA responsibility.  The LPA process allows for more local control in terms of design, cost and schedule of the project.  The agreement requires the LPA to follow the federal process for item including, right-of-way acquisition, selecting consultants, contracting, invoicing, using domestically made materials and the environmental clearance procedures on the projects. 

The City originally secured Congestion Mitigation/Air Quality (CMAQ) funding via AMATS in 2018 for the South Main Street Improvement Project. The project was designed and then originally bid in April, 2022 and bids received were in excess of 10% of the engineer’s estimate and consequently rejected.  Due to bids coming in over the original estimated budget, staff reached out to AMATS for additional funding as AMATS may provide for up to an additional 15% increase in federal funding, if funds are available.  AMATS indicated that additional funding would be available, and staff then rebid the project in July, 2022.  Based upon the updated bids and available funding, AMATS is providing an additional $290,400 in funding, bringing the total CMAQ grant amount to $2,790,400 ($2,500,000 original grant + $290,400 in additional funding = $2,790,400 total).

Due to the change in CMAQ funding, a modified LPA Agreement is required.   As the project is anticipated to commence with construction later this summer, an emergency clause has been added in order to properly document the increase in funding and commence with the project’s construction.

It is recommended that City Council approve the resolution authorizing the City Manager to enter into the amended LPA agreement with ODOT for the SR 91 S. Main Widening Project.
