Council awarded allotments of special merit to this project in 2008; however the allotments and the approval of the previous site plan have expired.
Purpose & Explanation
The developers of Hudson Station have reduced the scope of the previously approved site plan to be 6,000 square feet of commercial space north of the parking lot north of Chipotle and 16 townhomes.  Council, following recommendation by Planning Commission, may award up to 30 residential development allotments according to Section 1211.04(h) of the Land Development Code.  At its June 10, 2013 meeting, in addition to approving the final site plan, PC recommended that Council award five to eight residential growth allotments of special merit for this project.  Attached to this legislative memorandum is the June 10 PC staff report pertaining to the matter wherein this request is discussed.
As of June 10, the date the final site plan was approved, and thus the date the project is eligible for growth management allotments, 14 unused allotments were available for award.  If Council approves the four allotments of special merit as recommended, staff will award 12 regular unused allotments to Hudson Station leaving two for other property owners.
Timing Considerations
Three readings of this legislation are not required; therefore, it is eligible for action on July 17.  Planning Commission approved the site plan of the project June 10, 2012 making the project eligible for growth management allotments.  The residential portion of the project may be issued zoning certificates upon award of allotments and fulfillment of PC conditions of site plan approval.
