Purpose & Explanation
The original contract for the construction of the Manor Drive Waterline and Storm Sewer Improvement included a 10% Waterline Contingency and 7.2% Storm Sewer Contingency for a total amount of $678,895.32. Through the course of the construction, a number of unanticipated issues were discovered that utilized all of the contingency funds. The additional issues included additional water main, bend and casing pipe at W. Streetsboro Road to avoid disturbing existing utilities, removal and replacement of unforeseen, failing storm pipe, extra storm sewer, additional drive apron replacement, additional grading, and additional grass restoration.
Staff is requesting an additional $9,316.00 ($4,658.00 Water Fund and $4,658.00 Storm Fund) bringing the revised construction contract to $688,211.32 ($9,316.00 + $622,237.00 + $56,658.32 = $688,211.32).
Timing Considerations
Upon authorization to proceed by the City Council, the administration will issue applicable Change Orders to the contract with Liberta Construction.

Staff recommends that City Council approve this Resolution authorizing the City Manager to amend the contract with Liberta Construction for the Manor Drive Waterline and Storm Sewer Improvement Project and we are requesting an emergency clause be added to this legislation in order to close the project out with Liberta.
