Title

A Motion Directing the Clerk to Send Notice to the Ohio Division of Liquor Control Indicating No Request for a Hearing Regarding a New Permit and the Transfer of a Permit to Sell Alcoholic Beverages for Highfields Event Center LLC, 1940 Georgetown Road, Hudson.

Brief Description:   The Clerk is in receipt the two Notices to Legislative Authority from the Ohio Division of Liquor Control concerning the opportunity to request a hearing.

Purpose & Explanation

Attached are two Notices to Legislative Authority concerning the following Liquor Permits: 

 

Permit Class & Description:  Restaurant / Night Club

●  D1 (new) - Beer only for on premises consumption or in original sealed containers for

carry out only until 1:00am. (ORC 4303.13) 

●  D2 (transfer) - Wine and mixed beverages for on premises consumption or in original sealed containers for carryout only until 1:00am. (ORC 4303.14) *

●  D3 (new) - Spirituous liquor for on premises consumption only until 1:00am. (ORC

4303.15)

 

* The owners of Highfields Event Center were unable to apply for a new D2 Liquor Permit, as there were none available through the quota system, so they applied for an Economic Development Transfer (“TREX”).  As shown on the attached notice, the Division of Liquor Control can transfer a D2 Permit from Paceline Partners in Dublin, Ohio, to Highfields Event Center.

 

A criminal history search of City records was performed using information provided in separate correspondence to the Hudson Police Department, which included the names and Social Security numbers of the company’s managing members.  No records were found.

Timing Considerations

The Clerk of Council must respond to the Ohio Division of Liquor Control no later than October 28, 2019, concerning the City’s request for a hearing.

Suggested Action

Staff recommends that, based solely on the criminal history search described above, no hearing should be requested at this time.
