Title

A RESOLUTION AUTHORIZING THE CITY MANAGER TO APPOINT AN ADA COORDINATOR AND ADOPT AN ADA POLICY.

Brief Description:  Title II of the Americans with Disabilities Act requires that Public Entities ensure that persons with disabilities have access to programs, activities and services offered by the public entity. Included in the mandatory requirements are the designation of an ADA Coordinator and adoption and public notice of a policy, including a grievance procedure.

Purpose & Explanation

The requirements of the ADA Title II are set forth at 28 CFR Part 35. Title II requires public entities to take several steps to become compliant with the ADA. City infrastructure projects meet ADA requirements during construction, however, specific actions must be taken under the ADA by all public entities. The City must conduct a self- evaluation, provide public notice about the ADA, designate an employee to oversee Title II compliance, establish a grievance procedure, and develop a transition plan if structural changes are necessary for achieving program accessibility. The appointment of an ADA Coordinator and adoption of the grievance procedure will ensure that the City continues to take steps to fulfill the goals of the ADA in providing and improving access to programs, services and activities for all citizens.

 

Consistent with the discussion at the September 5 meeting of Council, the authorization of these two actions will fulfill the initial requirements of the ADA and allow evaluation and direction for further action.
