Purpose & Explanation

The Middleton Road and Stow Road Sidewalk Project includes the installation of five (5) foot concrete sidewalk, storm improvements, ADA curb ramps, lighting upgrades, intersection improvements and signing along Middleton Road.

During the final phase of the project design in the spring, the City’s engineering consultant began the private property valuation and acquisition process. Over the summer and fall, the consultant contacted and met with the affected property owners to review the plans, impacts to private properties and the valuations of the acquisitions. Staff elected to wait until all property acquisition approvals were secured from property owners before submitting the request to City Council and the final property owner approval was secured in October.

Due to the sidewalk installation and associated storm water infrastructure improvements, permanent acquisitions are required at three (3) parcels. See attached exhibit.    Note that the Middleton Road and Stow Road Sidewalk Project is split into three (3) phases as noted below.  The acquisitions are in Phase 1 and Phase 2 only.

Phase 1 - Middleton Road from SR 91 to High Point Park & Stow Road from Middleton Road to Chamberlin Boulevard

Phase 2 - Middleton Road from Valley View Road to SR 91 (construction in 2023)

Phase 3 - Stow Road from Chamberlin Boulevard, under I-480 to Pine Trails (schedule with ODOT’s I-480 Bridge Rehab Project)

See also attached table for each permanent take and agreed-to costs, based upon fair market value appraisals.

An emergency clause is being included in order to finalize the property acquisition necessary in phase 1, ahead of construction starting in late 2022.

Recommendation

Suggested Action

Staff recommends that Council approve the acquisitions related to the Middleton and Stow Road Sidewalk Project.  We further recommend that Council authorize the City Manager to sign the necessary documents to execute these transactions.
