Purpose & Explanation
Issue #1:  During the demolition of the Eastman School and Lincoln Cottage, Baumann Enterprises found Hazardous Material on the bottom of the floor slabs in each of the buildings.  
The City currently has a PO written for 10% of the contract ($1,283,034.25) which totals $128,303.43.  Thus far the City has used $27,602.00 of this contingency money leaving approximately $100,700.00.  Staff is asking Council to approve an additional $125,000.00 for the removal of this additional unknown Hazardous Material under this current contract, and any unforeseen hazardous soil beneath the slabs.
Issue #2:  During the excavation of several buildings, there is a hazardous material pipe network underground that we believe was used for the old steam lines to several buildings (the number of buildings is unknown at this time) that staff would like to discuss to see how City Council would like us to proceed.  The cost to abate and remove this pipe line network is estimated at $400/LF with approximately 1,060 LF for an estimated total cost of $424,000.00.
The Alternate to this above abatement is to remove the exposed pipe at each of the known or suspected locations for a cost of approximately $15,000.00.  With this option the pipe network would need to be removed at a future date and under a separate contract.
Timing Considerations
Once Council approves the additional monies, a change order will be processed to Baumann Enterprises.

Recommendation
Suggested Action
Staff recommends that council authorize staff to proceed with Issue #1 and approve the additional cost of this work totaling $125,000 and we also recommend performing the alternate work on Issue #2 in the amount of $15,000 and complete the pipe network abate/removal at a future date and contract.  We are requesting an emergency clause be added to this legislation in order to maintain the public health and welfare.
