Purpose & Explanation

City Council provided direction to staff at the April 25, 2021 workshop session.  Additionally, staff presented the draft amendments to the Architectural and Historic Board of Review on May 26, 2021.  Since the first reading by City Council the following has occurred:

Architectural and Historic Board of Review June 23, 2021:  Introduction to the draft amendments and preliminary discussion  

Planning Commission July 12, 2021:   Conducting of the public hearing and preliminary discussion.  Review was continued to the July 26, 2021 meeting.  

Architectural and Historic Board of Review July 14, 2021:  AHBR further discussed the amendments and forwarded a request to the Planning Commission to recommend approval of the amendments as presented with the condition to maintain all Historic District Development as Basic Development.  The AHBR notes an intention to permit smaller scale HD projects to be eligible for the consent agenda going forward.  This procedural change would still ale board members and the public to be notified of such applicants while providing an streamlined review process for applicants.   

Planning Commission July 26, 2021:    Planning Commission further reviewed the draft amendments and the recommendation from the AHBR.  After discussion, Planning Commission forwarded a unanimous motion to request Council adopt the 2021 LDC Update amendments subject to AHBRs request to maintain all Historic District Development as Basic Development.

The 2021 LDC amendments as recommended by the Planning Commission have been added as an attachment.

Council Workshop December 14, 2021:   Based on discussions at the workshop session, the amendment has been further revised to incorporate regulations related to childrens play equipment into Section 1206.03 Accessory Use/Structure rather than the previously proposed Section 1201 Features allowed within a setback.

Staff recommends City Council receive the recommendation of the Planning Commission, conduct a public hearing, and act on the proposed amendments.
