Title
A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INTO A CONTRACT WITH MARKS CONSTRUCTION, INC. FOR THE HERRICK CIRCLE POND IMPROVEMENT PROJECT; AND DECLARING AN EMERGENCY.
Brief Description: The project involves the grading improvements to allow for better maintenance and less flooding of an existing City maintained storm water detention pond located northeast of Herrick Circle in the subdivision of the Woods of Western Reserve. An emergency clause has been included to allow the contractor to begin the work this year, weather permitting, as grading work in the winter or spring can be difficult and problematic.

Resolution No. 21-76 - Permission to Bid and Award; 7/6/2021
Purpose & Explanation
A hydraulic study was performed to develop a solution to allow for better maintenance of a drainage ditch and detention pond system located behind homes on Herrick Circle. The study identified that a new 12” diameter outlet pipe shall be installed, lower than the existing pond bottom. The lower pond outlet will then allow for re-grading of the pond bottom and embankments and also allow for an increased slope of the low flow channel. Modifications to the existing outlet structure will also be performed. The hydraulic study verified that the new pipe installation will result in no increased flows to downstream properties will occur. With these improvements, the detention pond will be easier to routinely maintain by our Public Works Department, which will keep the pond functioning as designed.
The contract was advertised earlier this year, bids were opened on September 14, 2021, and all bids were in excess of 10% of the Engineers Estimate of $46,191.00. Staff reviewed the initial bid results and identified that the increase in costs were due to limited number of contractors bidding the project, time of year and limited project schedule. Due to the time of year for the second round of bidding, the contract was modified to allow the contractor to finish the project by Spring, 2022. However, an emergency clause has been included to allow the contractor to begin the work this year, weather permitting, as grading work in the winter or spring can be difficult and problematic.
The Engineers Estimate was revised to $118,503.00 based upon the previous bid results and the project was re-bid. The re-bid was opened on October 19, 2021, and the following bids were received:
Marks Construction $72,294.14
Workman Industrial Services $79,027.00
Woodford Excavating, LLC $85,999.00
Lockhart Concrete Company $124,816.60
Northstar Contracting, Inc. $139,170.00
City staff would like to award the project to Marks Construction, Inc. in the amount of $72,294.14, plus 10% contingency for a total contract award of $79,523.55.
