A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INTO A LICENSE AGREEMENT FOR A FENCE AT 374 NORTH MAIN STREET.

Brief Description:  This resolution authorizes the City Manager to enter into a license agreement with Suzanne Morgan to allow a fence installation to align with adjacent property fence setbacks within the City’s right-of-way at 374 N. Main Street in the Historic District.

Purpose & Explanation

Per Codified Ordinance 230.05, private improvements within the right-of-way require Council authorization.  City Manager authorization per 230.05 is limited to improvements within easements. 

 

The property owner at 374 N Main Street has requested to install a decorative wood picket fence in the front yard of their property.  The proposed fence is located within the City’s public right-of-way.  The proposed fence would be at the same setback and of compatible design to multiple adjacent properties on North Main Street.  After applying for a fence permit from the City, the property owner was informed by the CD Department that they needed a license agreement from the City to allow a fence to be placed within the City’s public right-of-way.  This resolution authorizes the City Manager to enter into a license agreement with Suzanne Morgan to allow the installation of a fence on N. Main Street in the Historic District.  The proposed fence received design approval from the Architectural & Historic Board of Review on August 26, 2020.
