Purpose & Explanation

Proposed Real Estate Exchange - Veterans Way / 61 Milford Drive

Background
During the construction of Veterans Way in 2002-2003, a small portion of roadway improvements encroached onto property located at 61 Milford Drive. At that time, the City and the property owner discussed a potential land exchange to reconcile the encroachment, and a revocable use permit was issued to allow construction to proceed. While the roadway project was completed, the land exchange was never finalized.  Reference attached exhibit. 

In recent years, the property owner reinitiated discussions with the City regarding completion of the exchange. In addition, Public Works staff identified a deteriorating retaining wall adjacent to Veterans Way that requires repair, further highlighting the need to resolve the property boundary and right-of-way issues.

Proposed Exchange
The City proposes to exchange approximately 6,163 square feet of City-owned property located along the south side of 61 Milford Drive (Summit County Auditor Parcels 3201841 and 3201844) for approximately 1,169 square feet of property located at 61 Milford Drive (Parcel 3200750), owned by Drensky Realty Investments, LLC.

Final property areas will be established through preparation of a new plat and recorded deeds. The exchange will be structured so that the value of the properties conveyed is equal for both parties. The agreement will also include easements for drainage and future construction access as necessary for City infrastructure maintenance.

Purpose
Approval of the exchange will eliminate the current condition where a portion of Veterans Way right-of-way is located on private property, ensuring that all City roadway infrastructure, including the sidewalk and retaining wall, is located entirely within the public right-of-way. The exchange will also bring the private property into compliance with City code and clarify long-term ownership and maintenance responsibilities.

Suggested Action

The City recommends Council approve this request to allow the City Manager to enter into an agreement with the property owner for the exchange of property as shown on the attached exhibit.
