Title

AN ORDINANCE AMENDING SECTION 1207.13, “TRANSPORTATION / CIRCULATION / PEDESTRIAN LINKAGE,” OF CHAPTER 1207, “ZONING DEVELOPMENT AND SITE PLAN STANDARDS,” OF THE LAND DEVELOPMENT CODE.

Executive Summary:  The ordinance amends provisions concerning traffic impact studies and fire access, and repeals standards better located in the Engineering Standards.

Legislative History

The Land Development Code was adopted in December 1999.  This amendment received first reading and was referred to Planning Commission June 21, 2016.  Planning Commission conducted its public hearing and rendered its recommendation July 11, 2016.

Purpose & Explanation

Since the Land Development Code was adopted several provisions in this chapter have become outdated.  The amendments address these provisions in the following ways:

1.                     References to several date specific documents in the chapter have been revised to refer to the most recent edition.

2.                     Standard road cross sections and standards for street design and pedestrian and bicycle paths have been repealed from the Land Development Code to be added to the Engineering Standards by the time this ordinance is adopted.

3.                     Standards as to when a Traffic Impact Study is required are moved to the Engineering Standards.

4.                     The maximum length of a cul-de-sac is increased from 600 to 900 feet based on the capacity of the Hudson Fire Department to access structures.

5.                     Exact specifications for fire access roads have been replaced with adherence to the Ohio Fire Code and review and approval of the Hudson Fire Department.

The proposed amendments were developed in consultation with and are supported by the Engineering and Fire Departments. Following its public hearing July 11, 2016, Planning Commission recommended that Council adopt the proposed ordinances as drafted.

Since Planning Commission’s meeting staff has discovered that one provision concerning the number of curb cuts that may be permitted may cause confusion with zoning district regulations.  We ask that Council to consider amending the ordinance at Section 1207.13 (c)(5)(C) as follows:

Residential development is permitted a maximum of two curb cuts per lot, subject to the district allowances of Section 1205, with a maximum width at the right of way of 20 feet per curb cut and a combined maximum of 30 feet per lot.

 

Timing Considerations

Following its public hearing Council may take final action at 3rd Reading September 6, 2016.
