A RESOLUTION AUTHORIZING THE CITY MANAGER TO ADVERTISE FOR COMPETITIVE BIDS, TO ENTER INTO CONTRACTS FOR THE CONSTRUCTION OF THE INCLUSIVE PLAYGROUND, AND TO UTILIZE THE COOPERATIVE PURCHASING PROGRAM FOR EQUIPMENT, INSTALLATION, AND SURFACING, AND TO ENTER INTO A REIMBURSEMENT AGREEMENT WITH THE HUDSON COMMUNITY FOUNDATION; AND DECLARING AN EMERGENCY.
Brief Description: This resolution is requesting authorization allowing the City Manager to advertise for competitive bids and enter into a contract for the construction of an all-inclusive playground and the utilization of a cooperative purchasing program for the installation of equipment and playground surfaces at Oak Grove Park on Barlow Road. It also seeks authorization for a reimbursement agreement with the Hudson Community Foundation, where the foundation agrees to reimburse the City for specified equipment and installation costs.

Purpose & Explanation
This resolution is for the construction of an inclusive playground at Oak Grove Park. The Hudson Inclusive Playground is a community-driven project designed to provide a welcoming, accessible, and enriching play environment for children of all abilities. This installation will transform the outdoor experience by welcoming everyone regardless of age, ability, or background. Thoughtful design features like accessible sensory-friendly play areas and adaptive equipment ensure that all visitors can participate, connect, and enjoy nature together. The final design for the Hudson Inclusive Playground has been completed and received formal approval from the Hudson Planning Commission.
As detailed below, the City staff seeks approval for advertising and awarding bids for the installation of the inclusive playground equipment, surface, etc. The staff also seeks authorization to enter a contract for certain equipment and installation through a cooperative purchasing program, which is permitted under Ohio law and Hudson Charter Section 6.04.
The City has received funding from the State of Ohio, which requires the City to use the funds before the June 2026 deadline. As such, the project must move forward as quickly as possible. The City will also execute a formal agreement with Hudson Community Foundation for reimbursement of a portion of the City’s costs for this project = $558,560.00 ($273,560 for Additional Equipment + $285,000 for Equipment Installation).
Construction Formal Bid:
The construction scope includes earthwork, asphalt paving, concrete work, landscaping, electrical, plumbing, site lighting, along with other related tasks. As with other contracts, City staff requests a contingency to handle any minor changes in the scope that arise.
With Council approval, the staff seeks legislation authorizing the City Manager to publicly bid for and award a construction contract for the project.
Construction Amount- $658,000.00
Construction Contingency Amount- $65,000.00
Total construction cost with 10% Contingency - $723,000.00
Cooperative Purchasing Program:
The installation’s scope includes equipment installation of all playground equipment and surfacing installation of all playground equipment areas.
With Council approval, the staff seeks legislation authorizing the City Manager to utilize a Cooperative Purchasing Program for the following item on this project: The installation of the playground equipment, installation and purchase of the playground surfacing, and the request for 5 swing with sunshade for this project. Cost of each Item: $285,000 - installation cost; $425,000 - surfacing cost, & the additional $145,000 - 5 swing equipment with sunshade.
Cooperative Purchasing Amount- $855,000.00
Total Budget Amount of $1,578,000.00
Hudson Community Foundation Commitment:
The Hudson Community Foundation has graciously committed specified dollars for specified equipment and installation:
• $285,000 for installation of all playground equipment.
• $273,560 for specific, additional playground and related equipment.
An emergency clause has been added to this legislation in order to timely construct the playground, utilizing the State of Ohio funding the City received for this playground. The project must be completed by June, 2026.

Staff recommends that City Council approve this Resolution: authorizing the City Manager to advertise for competitive bids and enter into a contract for construction of an inclusive playground; authorizing the utilization of a cooperative purchasing program for the installation of playground equipment and playground surfaces; and, authorizing a reimbursement agreement with the Hudson Community Foundation for a portion of the cost, all for the Oak Grove Inclusive Park, and declaring an emergency.
