Title

AN ORDINANCE AMENDING CHAPTERS 1205.04, 1205.06, 1205.07, 1205.11, AND 1206.01 OF THE LAND DEVELOPMENT CODE TO REMOVE TOWNHOMES FROM ALL ZONING DISTRICTS EXCEPT DISTRICT 5 VILLAGE CORE DISTRICT. 

Brief Description:  Proposed amendment to the Land Development Code to limit townhomes as a allowable dwelling unit type to District 5 Village Core District.

Purpose & Explanation

The attached proposed amendment to the Land Development Code would limit the allowance of townhomes as a dwelling unit type to District 5.  Presently, townhomes are permitted as a dwelling unit type in Districts 1,3,4,5, and 8Overlay.  The LDC definition for townhomes is as follows per Section 1213.02(111):   

 

"Dwelling, townhome" shall mean a single-family dwelling in a row of at least three such units in which each unit has its own front and rear access to the outside, no unit is located over another unit, and each unit is separated from any other unit by one or more vertical common fire-resistant walls.

 

The Planning Commission reviewed the request on March 31, 2025, conducted a public hearing, and unanimously passed a motion to recommend City Council proceed with the proposed amendment.

Planning Commission forwarded a recommendation to approve at their meeting of March 31, 2025.  Staff recommends City Council proceed with conducting a public hearing and the additional readings  reading.
