A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INTO AN AMENDMENT TO AN AGREEMENT WITH THE NORTHEAST OHIO REGIONAL SEWER DISTRICT (NEORSD) FOR FUNDING ASSISTANCE THROUGH THE NEORSD COMMUNITY COST SHARE PROGRAM FOR THE BARLOW COMMUNITY CENTER DAM IMPROVEMENT PROJECT.
Brief Description: The Northeast Ohio Regional Sewer District (NEORSD) collects storm water fees from property owners within their service area which includes Hudson properties within the Brandywine Creek watershed. NEORSD allocates 25% of the total storm water fees to the Community Cost-Share (CCS) Program and these funds are then available to communities to use towards storm water management projects and activities. To use the CCS funds, Cities must apply to NEORSD through a grant application and reimbursement process. This resolution would amend an existing application and agreement with NEORSD to use additional CCS funds towards the Barlow Community Center Dam Improvements Project.

Purpose & Explanation
The Northeast Ohio Regional Sewer District’s (NEORSD) Community Cost-Share (CCS) Program provides funding to member communities for community specific stormwater management projects. 25% of the total annual Stormwater Fee collected from each community is allocated to the Community Cost-Share Account of each community. The CCS funds are distributed via a reimbursement process in which the City requests funds from NEORSD once the storm water work has been completed.
In Hudson, the NEORSD CCS Program generates approximately $125,000/year and the current Hudson CCS balance as of December 2021 is approximately $270,000.
In the summer 2021, the City had requested and secured $50,000 of the City’s CCS funds for use towards the Barlow Community Center Dam Improvement Project.
In the fall of 2021, the Barlow Community Center Dam Improvement project was bid, and all bids came in 10% over the estimate, with the lowest bid coming in at 38% (+$515,358) over the engineers’ estimate. By State of Ohio OAC, the project must be rebid since it was over 10% of the estimate.
To help offset the increased cost of the project, staff is recommending increasing the total NEORSD Community Cost Share fund usage for the Barlow Community Center Dam Improvement project from $50,000 to $300,000 by utilizing an additional $250,000 in Community Cost Share funds.
Timing Considerations
Following the review and approval of this Resolution by City Council, the City will apply and secure approval from NEORSD for an amended use of the City’s Community Cost Share funds.

Suggested Action
Staff recommends that City Council authorize the City Manager to enter into the Community Cost Sharing Agreements and into a contract with NEORSD for the construction costs associated with the Barlow Community Center Dam Improvement Project.
