Executive Summary: This Resolution would authorize a $6,500 increase to the original design contract for engineering design services related to the design of the Valley View Road Storm Water Pond Project.

Purpose & Explanation
The Valley View Road Storm Water Project construction is being funded by a $355,000 Ohio Turnpike Mitigation grant awarded by the Ohio Department of Transportation in 2017. The project includes the design, permitting and construction of a new storm water management pond, on City-owned property, north of the Ohio Turnpike, near Brandywine Creek.
During the course of design and review, ODOT identified that a Phase 1 Environmental Assessment (ESA) would be required to support their Environmental Clearance Report. A Phase 1 ESA is used to verify if any historical property uses have impacted the soil or groundwater beneath the property and could pose a threat to the environment and/or human health. This extra report was paid for through the project’s original contingency amount of $3,600.
In addition, initial field review of the site originally identified that the project would avoid all wetland and stream impacts. The U.S. Army Corp of Engineers (USACE) conducted a follow-up, field delineation of the site this summer and determined that one of the site’s drainage ditches should be classified as a jurisdictional stream that will be impacted by the grading of the project. Due to the stream impacts, additional USACE permitting will be required. The cost for the USACE permitting is estimated at $6,500. Any fees required for the permit application will be paid for by the City.
As the additional USACE permitting cost is over the original design contract amount of $39,600 ($36,000 base fee + $3,600 contingency) with OHM Advisors, an amendment to the design contract is required.
Construction of the project is scheduled for 2020.
Timing Considerations
Following review and approval of this resolution by City Council, the City Manager will enter into an addendum to increase the contract for OHM Advisors.

Suggested Action
Staff recommends Council authorize the increase in the contract in order to maintain the public health and welfare for the construction of this project, and we are requesting an emergency clause be added to this resolution in order to keep the project on schedule.
