Title

Ordinance No. 18-93, (proposed) amending various Sections of Chapters 1201, 1202, 1203, 1204, 1205, 1206, 1207, 1208, 1209, 1210, 1211, 1212, and 1213 and at Appendixes A, B, and C of the City of Hudson’s Land Development Code, nka the “Planning and Zoning Code”; given first reading at June 19, 2018, City Council meeting and was referred by City Council to the Planning Commission for review and recommendation.

Purpose & Explanation

Pursuant to Section 1203.03(c)(1)(B) of the Hudson Land Development Code (the “LDC”), Planning Commission must make a recommendation relative to any proposed LDC amendments within 120 days from the date of receipt of the proposed amendments from City Council.  Pursuant to Ord. No. 18-93, City Council referred the initial set of proposed LDC amendments to the Planning Commission for recommendation on June 19, 2018.  Thereafter, during meetings of the Planning Commission, City Staff presented the initial set of proposed LDC amendments and heard public testimony concerning said amendments during public hearings of the Planning Commission.  On September 24, 2018, after receiving feedback on the initial set of proposed amendments during Public Hearings before the Planning Commission from the Community, City Leadership, and the Planning Commission, the City’s Planning Staff submitted a revised set of proposed amendments that significantly narrowed the scope of the amendments to be primarily administrative in nature.   Currently, the Planning Commission’s 120-day review window is set to expire on October 17, 2018.  Due to the recent narrowing of the scope of the proposed amendments and the submittal of a revised draft (LDC Update Draft dated September 24, 2018) City Staff seeks an extension to the 120-day period from which Planning Commission must make its recommendation back to City Council on Ord. No. 18-93.  Approval of this motion will provide additional time for Planning Commission to review and take public comment on the newly revised proposed LDC amendments.

Timing Considerations

The deadline for Planning Commission recommendation will be extended from October 17, 2018, until February 14, 2019.
