Purpose & Explanation
Prestige Homes has resumed the approval process for The Reserve at River Oaks a proposed residential subdivision east of Hudson Crossing Industrial Park between Boston Mills Road and West Streetsboro Street.  One of the requirements of the Land Development Code is to provide a secondary means of access.  Prestige had proposed a route for this access through the subject 91.5 acre office/industrial parcel, which it owns.  Prestige believes that rezoning this parcel to residential would make more efficient use of this land on which the wetlands would make office/industrial development difficult and provide a permanent location for the secondary access.  Rezoning this parcel could result in the expansion of The Reserve at River Oaks from a 144 lot project over 353 acres to a 232 lot project over 445 acres.
At its public hearing on March 10, Planning Commission recommended that Council approve the zoning map amendment.  Further, Planning Commission recommended that three parcels west of the subject parcel be included in the rezoning.  The three parcels were duly including in the public notice of Planning Commission's public hearing and each of the two properties owners were individually informed of the pending action.  Planning Commission noted that the school district could accommodate additional students; a District 6 build-out analysis found that the parcel is not developable for commercial -industrial development; site constraints make commercial-industrial development impractical; and the proposed plan does or can conform to LDC standards.
Timing Considerations
Staff contemplates the following schedule: 1) first reading February 5, 2) Planning Commission public hearing and recommendation March 10, 3) second reading April 2, and 4) Council public hearing and final action April 16.
