A RESOLUTION AUTHORIZING THE CITY MANAGER TO ADVERTISE FOR BIDS AND TO ENTER INTO A CONTRACT FOR THE N. OVIATT STREET PHASE 1 IMPROVEMENTS TO THE COLLECTION SYSTEM WITH THE LOWEST AND BEST BIDDER.
Brief Description: Residents on N. Oviatt Street notified the city that during a 2022 heavy rain, flows caused overland flooding near their homes. The N. Oviatt Street Storm Improvement Project involves increasing the number of access points for water to get into an existing storm box culvert. The improvements will reduce the overland flooding, with an estimated project cost of $100,000 including a 10% contingency.

Purpose & Explanation
Between 167 Hudson Street and 46 E. Streetsboro Street, within the City’s Historic District, exists a 100-year-old storm system that consists of a series pipes and box culverts installed in the late 1920’s. Limited access to the box culverts allows surface water to run overland causing flooding during heavy rain events, especially if inlets become clogged with leaves and other debris. The overland flooding has affected properties between 54-80 N. Oviatt Street and the residences along Ellsworth Court up to the rear of properties on Division Steet. See Exhibit A attached.
The Engineering Department will prepare permanent easements for all storm sewer areas being improved outside of the right-of-way. Work agreements will also be included during construction.
Results from a 2023 drainage study of the area determined that the existing box culverts were undersized. Phase 2 of the project will involve monitoring flows and some upgrades to the storm infrastructure.
The 2022 Stormwater Policy for work on Private property has been reviewed and found to apply to this project based on the following:

4. Potential for Damage to Structures when flooding occurs.
The Engineering Department will design the project in-house, and the storm sewer work will include limited work in the roadway. The work is scheduled to be completed by Fall, 2024.
The estimated project cost of construction including a 10% contingency is $100,000.
Following the approval of this Resolution by City Council, the Engineering Department will advertise in the local newspaper and receive bids for this project. Staff will only return to Council if the bids received are in excess of 10% of the Engineer’s Estimate; otherwise, the City Manager is authorized to enter into a contract with the lowest and best bidder.
