Purpose & Explanation

The easements are being purchased for the construction and maintenance of the new storm system on Norfolk Southern property as shown on the attached exhibit.  Two (2) permanent easements are being purchased; one for the installation of the new storm culvert under the railroad tracks, and the other for the storm running parallel to the tracks on Norfolk Southern property.  Four (4) temporary easements are being purchased for construction access, grading, and for grout filling of an existing storm culvert under the tracks.

 

The finished negotiation costs following 19 months of negotiations:

The Downtown Railroad Culvert Improvement project will consist of the installation of approximately 150 feet of new 36” smooth steel culvert under the Norfolk Southern Railway Company railroad tracks and 400 feet of 36” concrete storm sewer adjacent to the railroad tracks.  The alignment of this section of culvert under the trails was chosen to avoid relocation costs of existing fiber optic communication lines in the area.

Timing Considerations

The process of the temporary and permanent easements will be finalized immediately following Council approval of this request.

Suggested Action

Staff recommends Council approve the purchase of the temporary and permanent easements from Norfolk Southern Railroad for the Downtown Railroad Culvert Improvements.  We further recommend that Council authorize the City Manager to execute the necessary documents to execute this transaction.  The City staff is also requesting that an emergency clause be added to the legislation in order protect the public welfare and safety.
