Executive Summary: The Collection Auto Group has submitted a letter indicating that the owners no longer wish to pursue rezoning of the residential portion of the subject property; therefore, a motion to remove Ordinance No. 12-127 from the table and withdraw it from any further Council consideration is in order.

The zoning map was last amended on April 18, 2011. This particular amendment was brought to Council in the fall of 2012.
Purpose & Explanation
On September 10, 2012 Planning Commission recommended that Council rezone parts of 5715 and 5724 Darrow Road from District 3 to District 7 for the purpose of allowing Collection Auto Group to expand into the rezoned land. PC further recommended that part of the rezoned land be placed in a conservation easement. Council at the request of the applicant in a letter dated November 19, 2012 at its meeting of the same date voted to table until November 6, 2013 an ordinance to adopt the zoning map change and a related resolution related to the conservation easement. The applicant's letter specifies the following: "within the twelve (12) month period we will either request that the Council again place the rezoning on the agenda, or will notify the City that our rezoning request is withdrawn. We understand that if we make neither request of the City within such twelve (12) month period, any request for rezoning will have to be considered a new request."
Timing Considerations
At the request of the applicant in a letter dated November 19, 2012, Council voted to table this matter at its meeting of the same date until November 6, 2013.
A letter from The Collection Auto Group dated November 6, 2013, indicated that the applicant is no longer interested in pursuing rezoning of the subject property.
