Brief Description: Authorization for the City Manager to enter the City of Hudson into a License Agreement with restaurants in the downtown district for outdoor dining within the Downtown Hudson right-of-way sidewalk zone.

Legislative History
Resolution No. 04-183 authorized the City Manager to enter into License Agreements for restaurant sidewalk seating following the opening of First and Main in 2004.
Resolution No. 2011-103 authorized the City Manager to enter into a site-specific License Agreement for restaurant sidewalk seating at 49 Village Way.
Resolution No. 2011-104 authorized the City Manager to enter into a site-specific License Agreement for restaurant sidewalk seating at 60 Village Way.
Purpose & Explanation
The City has received requests from Downtown 140 and Comida to establish outdoor dining areas within the public sidewalk area. Additional restaurants within the Downtown District may also wish to establish or expand their outdoor areas in the coming months. The Land Development Code permits outdoor dining as an accessory use per Section 1206.03(10). An administrative zoning certificate, including review by the Community Development and Engineering Departments, would be required for the proposed accessory use and associated improvements.
The attached License Agreement would require plan review/approval, maintenance of a five-foot walk zone (seven foot for N. Main Street), confirmation of State of Ohio Liquor Control compliance, insurance, indemnification, maintenance standards, and the ability to terminate.
Authorization to execute License Agreements was provided for the First & Main District in 2004 per 2004-183 (described as Downtown Redevelopment Area); however, it did not capture North Main Street. The License Agreements authorized in 2011 were site specific agreements which were beyond establishment of use areas and included construction of public infrastructure.
The proposed boundary is for restaurants within the attached exhibit and detailed as follows:
1. North Main Street from St. Rt. 303 to Owen Brown Street
2. Clinton Street from North Main Street to Morse Road
3. First Street from St. Rt. 303 to Clinton Street
4. Park Lane
5. Village Way
6. Library Street

Does this legislation require use of an emergency clause?
X Yes, Staff is recommending the emergency clause due to the challenges imposed upon restaurants to reopen during the COVID-19 pandemic while complying with the applicable social distancing requirements of the State of Ohio Health Department. Additionally, City Council has authorized three previous ordinances for similar License Agreements within the district.
