Resolution No. 23-50 - Authorized Amendment to Everstream Solutions Contract; 4/18/2023

Purpose & Explanation

23-50 was approved by council on 4/18/2023, which amended the contract entered into with Everstream Solutions, LLC (Resolution No. 21-4, approving a contract with Everstream, passed on February 16, 2021) for a term of three-years. Since enactment of 23-50 an updated contract (dated 6/21/2023) was negotiated and implemented with Everstream Solutions, LLC providing the upgrade in services from 2Gig to 10Gig capacity.

23-50 contained the effective date of annuary 1, 2024. That date, however, was not the intended date of the upgrade; city staff intended the upgrade to be immediate upon the effective date of the legislation and proceeded in that manner.

The purpose of this amendment to 23-50 is to remove the incorrect effective date of January 1, 2024 to reflect the intent that the upgrade be effective immediately.
