Legislative History

17-202 - Authorized Feasibility Study with Arcadis, US, Inc.; 12/27/2017
19-79 - Enter into Cost Share Agreement with NEORSD; 5/21/2019

Purpose & Explanation

In April 2017, the Ohio Department of Natural Resources (ODNR), Division of Water Resources, inspected both the Upper and Lower Lake Dams at the Barlow Community Center.  ODNR identified that both dams require improvements to the primary spillways and emergency overflows in order to meet the updated design criteria as designated by the Ohio Administrative Code.

In March 2019, City of Hudson, in association with the Northeast Ohio Regional Sewer District (NEORSD) finalized a study titled the “Cuyahoga River South (CRS),

Stormwater Master Plan (SWMP) - City of Hudson Community Report”.  The CRS SWMP

study identified problems and recommend stormwater solutions, within the Brandywine Creek Watershed, to improve regional storm water management and water quality in the watershed.   The study recommended improvements to the Barlow Community Center’s Upper Lake, including increased storm detention volume and operational controls.

In April 2019, the City’s and its consultant finalized the “Feasibility Study for the Barlow Community Center Dams”.  The feasibility study developed a set of alternative design solutions to meet the ODNR dam requirements and verified that the additional storage volume identified in the CRS SWMP can be constructed.

In May 2019, NEORSD confirmed that it would reimburse the City for the cost of the design and construction of the required ONDR dam improvements and recommended storm water management improvements at the Barlow Community Center Dams.

City staff selected ten (10) qualified consultants to submit a technical proposal and a separate, sealed fee proposal, for the design of the Barlow Community Center Dam Project that will address both the ONDR and suggested NEORSD improvements.  A total of eight (8) of the consultants submitted proposals.  The City and NEORSD reviewed all of the technical proposals and selected the top three (3) consultant’s technical proposals.  City staff then opened those top three consultant’s sealed fee proposals and selected the consultant with the lowest fee to perform the design.  The consultant with the best technical proposal and lowest design fee is Environmental Design Group (EDG).   The total design fee for EDG is $291,473.10.  Costs for the other two consultants whose fee proposals were opened are noted below.

Selected Consultant’s Design Fee:

EDG fee = $ $291,473.10

Other consultants:
EMH&T = $358,059.00
Michael Baker = $307,610

The cost breakdown for EDG’s Design Fee is as follows:

Base Fee                     $249,506.79
Reimbursable Expenses
                     $1,000.00
Bathymetric Survey (if necessary)
                     $6,406.49
Additional Environmental Permitting (if necessary)
                     $9,325.98
Additional Meeting (if necessary)
                     $1,891.55
Bid Support and Construction Assistance
                     $11,349.09
Additional Preliminary Design for Alternate Design Options                     $11,993.20

Total                     $291,473.10

As with other professional service contracts, we are requesting a 10% contingency to handle any minor changes in the scope of services.  For this contract the 10% amount would be
$29,147.31 for a total budget amount of $320,620.41.  For any considerations above this requested amount, the City staff would return to the City Council.

All of this design fee will be 100% reimbursed by the Northeast Ohio Regional Sewer District.
