Legislative History

The Hudson Library and Historical Society has a 2.3 mill operating levy that will expire at the end of tax year 2015 (collection year 2016).  The Library is requesting renewing the 2.3 mills and increasing it by .6 mill for a total of 2.9 mills.

Purpose & Explanation

The Library made a presentation to City Council at the August 4, 2015 Council meeting explaining the need to renew the operating levy and increase the millage.  The Library does not have legal authority to place a levy on the ballot and has requested City Council do it on the Library’s behalf.

There are two separate resolutions required to be passed by Council.  The first is the resolution of necessity and requesting the County Fiscal Officer certify the estimated revenue from the levy; the second resolution is to approve putting the levy on the ballot.

Timing Considerations

Below is the schedule to put the levy on the ballot:

 

Tues. Aug. 4                     Library presentation and discussion at Council workshop

Tues. Sept. 1                     Resolution of Necessity - first reading and passage by suspension of the rules

Wed. Sept. 2                     Certify Resolution of Necessity to Summit County Fiscal Officer

Tues. Sept. 15                     Resolution to put the levy on the ballot - first reading

Tues. Oct. 6                     Resolution to put the levy on the ballot - second reading

Tues. Oct. 20                     Resolution to put the levy on the ballot - third reading (and passage)

Tues. Dec. 16                     Due date for certification to Board of Elections (90 days prior to election day)

Tues. Mar. 15                     Election Day

 

Fiscal Impact

No direct fiscal impact on the City.  The City acts as a conduit for the levy proceeds.

Suggested Action

Staff recommends City Council pass the Resolution of Necessity and requests certification from the County Fiscal Officer.  We request this Resolution be passed as an emergency to allow adequate time to obtain the Fiscal Officer’s certification and three readings of the Resolution to put the levy on the ballot.
