Legislative History
The zoning map was last amended on April 18, 2011. A prior application to rezone this property did not pass as a result of a tie vote at the Council meeting of May 7, 2014 (Ordinance No. 14-19).
Purpose & Explanation
Although Council did not pass the previous application, Prestige Homes feels strongly that residential use of the parcel is in the best interest of the City.  In addition to the required submittal materials, Prestige has prepared additional information that it hopes will address Council's concerns including a 58 page traffic impact study plus appendices dated July 7, 2014, the Executive Summary of which is attached.  Also attached is a letter from Mr. Chris Brown, Prestige Homes Director of Land Development, that highlights the applicant's position.  Prestige is hopeful that it can make brief presentations at workshops at which this case might be discussed.
As background Prestige Homes is developing The Reserve at River Oaks, a residential subdivision east of Hudson Crossing Industrial Park between Boston Mills Road and West Streetsboro Street.  The only viable location for a required secondary means of access for the northern part of the subdivision is through the subject parcel. Prestige believes that rezoning this parcel to residential would make more efficient use of this land generally and would make use of the approximately 3,000 foot long road beyond emergency access. The location of wetlands on this parcel makes office/industrial development impractical.  Rezoning this parcel could result in the expansion of The Reserve at River Oaks from a 144 lot project over 353 acres to a 232 lot project over 445 acres. If this application is successful, the applicant plans to apply for the residential subdivision of this land and will have to meet all City requirements pertaining to zoning, emergency access, and traffic and environmental impact. Phase I, consisting of 47 lots immediately east of the subject parcel, has been approved.  Installation of improvements could commence this year.
PC previously recommended approval of the map amendment.  Following its public hearing August 11, PC unanimously recommended Council approve the zoning request only for the subject parcel.  Further it recommended that Council initiate a zoning map amendment on the three parcels to the west of the subject parcel from District 6 to District 3.
Timing Considerations
Because the previous application did not pass, Prestige has begun the approval process again.  The second application for rezoning was submitted May 27.  Council conducted its first reading August 6 and referred the case to PC.  PC held its public hearing and recommended approval of the amendment August 11.  Council must conduct a second reading and a public hearing, then take final action.  We anticipate the following schedule: second reading August 20, public hearing October 1, and final action October 15.

Staff recommends Council accept the recommendation of the Planning Commission and approve the application for rezoning the subject parcel and further that Council initiate a zoning map amendment on the three parcels to the west of the subject parcel from District 6 to District 3.
