Brief Description:   The City enters into an annual agreement with the Summit County Public Defender’s Commission for the defense of indigent defendants.  This Resolution authorizes such an agreement during the year 2024.

Legislative History

Pursuant to Chapter 120 of the Ohio Revised Code and Administrative Code 120-1-09, City Council annually authorizes the City Manager to enter into an agreement with the Summit County Public Defender’s Commission for the defense of indigent defendants.

Resolution No 22-168 authorized the 2023 agreement, passed December 28, 2022.

Purpose & Explanation

The City incurs costs for the defense of indigents in the Stow Municipal Court and is obligated to pay for the services provided, pursuant to Chapter 120 of the Ohio Revised Code and Administrative Code 120-1-09.  For 2024, there will be an increase from $170/defendant to $210/defendant.

The Legal Defenders Office has requested approval of legislation authorizing contract services for the defense of indigents for cases opened during the period from January 1 through December 31, 2024.
