Brief Description:   The City enters into an annual agreement with the Summit County Public Defender’s Commission for the defense of indigent defendants.  This Resolution authorizes such an agreement during the year 2023.

Legislative History

Pursuant to Chapter 120 of the Ohio Revised Code and Administrative Code 120-1-09, City Council annually authorizes the City Manager to enter into an agreement with the Summit County Public Defender’s Commission for the defense of indigent defendants.

Resolution No 21-159 authorized the 2022 agreement, passed December 21, 2021

Purpose & Explanation

The City incurs costs for the defense of indigents in the Stow Municipal Court and is obligated to pay for the services provided, pursuant to Chapter 120 of the Ohio Revised Code and Administrative Code 120-1-09.  For invoices received for January 2022 to June 2022, one (1) case was billed at a rate of $170.00 per case. 

The Legal Defenders Office has requested approval of legislation authorizing contract services for the defense of indigents for cases opened during the period from January 1 through December 31, 2023.
