A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INTO A PROFESSIONAL SERVICES CONTRACT WITH O.R. COLAN ASSOCIATES, INC. FOR RIGHT-OF-WAY ACQUISITION SERVICES FOR THE STATE ROUTE 91 SOUTH SAFETY IMPROVEMENT PROJECT (PID 106445).
Brief Description: The SR 91 South Safety Improvement Project design limits are on SR 91 (S. Main Street) from Barlow Road to the Stoney Hill Drive intersection. The project scope includes the widening of SR 91 to accommodate a center two-way left turn lane and resurfacing throughout the project length, 5-foot-wide bike lanes and sidewalks will be constructed on the east and west side of SR 91, traffic signal upgrades, storm sewer improvements, and repair to heaving shoulders.

Purpose & Explanation
The study and design of the SR 91 South Safety Improvement Project is nearing completion. The project design includes a new roadway section consisting of three - 11 ft. wide lanes (2 thru lanes and one center turn lane), 5-foot on-street bike lanes on each side, along with a 5-foot concrete sidewalk on each side of the road. Other project improvements include traffic signal upgrades, storm sewer improvements, and repair to heaving shoulders. The final design of the project is currently in progress and is anticipated to be completed by Fall, 2021. Project construction is scheduled for 2022.
Due to the widening of the roadway and other improvements, temporary right-of-way acquisitions are required from approximately 14 parcels along SR 91. Federal funds are being utilized for the construction and right-of-way services for this project, therefore, the City must follow the ODOT approved process for consultant selection, right-of-way acquisition and review appraiser services.
A request for design qualifications for the right-of-way acquisition services for the project was publicly advertised and we had five firms submit. (Transystems Real Estate Consulting Inc., MS Consultants Inc., O.R. Colan Inc., AECOM, and West Erie Realty Solutions). After City staff evaluated the qualifications, O.R. Colan was selected to submit a fee proposal. This process, Quality Based Selection (QBS), is the approved method of consultant selection by (ODOT). The City negotiated with O.R. Colan and settled on a fee of $60,800.00. We are requesting a 5% contingency to handle any minor changes in the scope of services that may occur during the course of the right-of-way acquisition preparation. The 5% amount would be $3,040.00, for a total contract amount of $63,840.00. For considerations in excess to this amount, we will return to the City Council for any additional funds necessary to correct or adjust the situation. (Note that the actual temporary right-of-way purchase costs have yet to be determined.)
The consultant performing the right-of-way acquisition services is responsible for the title research, fair market value appraisal/estimate, communication with property owner and negotiation of an agreed sale price of the land.
As part of our due diligence, the City spoke with ODOT regarding typical fees for this type of services. Based on the ODOT Fee Guidance information provided, the fee proposal submitted by the right-of-way acquisition consultant is within normal range for this type of project.
The right-of-way acquisition cost funding will be split 90%/10% (Federal/City).
Base Fee = $ 60,800.00
Federal Funding (90%) = $ 54,720.00
Hudson Funding (10%) = $ 6,080.00
Contingency (5%) (100% City) = $ 3,040.00
Total City Cost = $ 9,120.00
Staff will enter into a contract with O.R. Colan Associates Inc. to begin the right-of-way acquisition services after Council approval. The anticipated schedule for the completion of the construction of the improvements is 2022.
