A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INTO A WATER AND ELECTRIC ACCESS EASEMENT AGREEMENT AND A SIDEWALK EASEMENT AGREEMENT WITH 5698 HUDSON LLC. FOR THE PROPERTY AT THE SOUTHWEST CORNER OF TEREX ROAD AND HUDSON DRIVE; AND DECLARING AN EMERGENCY.
Brief Description: This Resolution authorizes the City Manager to enter into a Water and Electric Access Easement Agreement and a Sidewalk Easement Agreement with the 5698 Hudson LLC., also known as ShopCo, to permit Hudson Public Power and Water to enter the site for routine maintenance of City Infrastructure and for a 4’ Sidewalk Easement that allows for the installation of a 5’ sidewalk along the south side of Terex Road from Hudson Drive west to City of Hudson City Hall property.

Purpose & Explanation
This Resolution authorizes the City Manager to enter into a Water and Electric Access Easement Agreement and a Sidewalk Easement Agreement with 5698 Hudson LLC. also known as ShopCo. to permit Hudson Public Power and Hudson Water to enter the site for routine maintenance of City Infrastructure and for a 4’ Sidewalk Easement that allows for the installation of a 5’ sidewalk along the south side of Terex Road from Hudson Drive west to City of Hudson City Hall property. This portion of the City Sidewalk will occupy 4’ of land outside of the Public Right-of-way due to Utility Pole and Drainage conflicts.
