A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INTO A LICENSE AGREEMENT FOR A FENCE AND SIGN AT 60 WEST STREETSBORO STREET.

Brief Description:  This resolution authorizes the City Manager to enter into a license agreement with MBI Real Estate Inc. to allow their tenant, Noble House Restaurant, to repair and replace their longstanding fence and sign in the City’s right-of-way on West Streetsboro Street.

Purpose & Explanation

The Noble House restaurant recently approached the City with its intention to repair and replace the previously existing fence and sign in the front yard of the restaurant’s property.  The current (and proposed) fence and sign is located within the City’s public right-of-way.  The replacement fence and sign will go in the same location and be nearly identical to the existing fence and sign which has been in the same location as it is today for many years.  This resolution authorizes the City Manager to enter into a license agreement with the owner of the Noble House property, MBI Real Estate, Inc., to allow Noble House to repair and replace their longstanding fence and sign at 60 West Streetsboro Street.  The proposed replacement fence and sign will still need to subsequently receive approval by the Community Development Department and the City Engineer.

As a bit of background, this is not an issue of first impression.  Council has historically granted license agreements to property owners who wish to retain fences, signs, or other structures within the public right of way upon demonstration of need and/or historical significance.
