Title

A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INTO A LICENSE AGREEMENT FOR A DUMPSTER ENCLOSURE TO BE PLACED ON CITY LAND BEHIND THE MAIN STREET STORES IN THE DOWNTOWN AREA.

Brief Description:  This resolution would authorize the City Manager to enter into a license agreement with Farmer’s Rail of 98 North Main Street to permit a private dumpster enclosure to encroach into the city owned parcel associated with the parking terrace.

Body

Legislative History

Similar agreement established for a shared dumpsters for Hudson Restaurant and Kepner’s Tavern per Resolution 21-22 adopted March 2, 2021.

Purpose & Explanation

The Farmer’s Rail (98 N Main) has been operating for an extended time period with a dumpster placed adjacent to their rear loading dock.  This dumpster is without an enclosure to screen and currently encroaches onto city property (Parcel 3203938).  City staff have worked with the business for an extended period to research smaller dumpsters, revised relocations, and more frequent servicing in an effort to find a solution fully within the private parcel.

Staff has provided additional background within the attached memo in response to the discussion from September 12, 2023.
