Purpose & Explanation

The Land Development Code regulations required a total public open space dedication of 13.91 acres or equivalent dedication for the Reserve at River Oaks.  The Planning Commission approvals when the subdivision was established acknowledged the requirement was met with the dedication of 311 acres of conservation land within the subdivision and establishment of 7,400 ft multipurpose trail connecting Boston Mills Road to West Streetsboro Street through the northern and southern phases of the Development. 

In 2018 the developer returned to the Planning Commission seeking to revise the dedication as the proposed trail was not feasible due to impacts to high quality wetlands by construction of a water main and multipurpose path via the original alignment to West Streetsboro Street along with maintenance concerns with an underground water main alignment through wetlands.  Due to the wetland impacts and maintenance concerns, alternate alignments for the water main and path were proposed.  Planning Commission approved a developer payment of $625,610.94 to fund the water line (separately required for the project and installed by the city) and for the funds to be put towards a larger city led trail effort to extend the multipurpose path along Boston Mills Road east towards Boston Mills Park and Lake Forest Drive to allow a pedestrian connection into downtown.
