The subject of this hearing are the following variance requests relevant to the construction of an in-ground pool:
1. A variance request to allow an in-ground pool, an accessory structure/use, to be located in the side yard when the Land Development Code prohibits accessory structures from being located in the side yard pursuant to section 1206.03(d)(3), “Accessory Uses/Structure - Accessory Use Development and Operation Standards” of the City of Hudson Land Development Code.
2. A variance request to permit an in-ground pool in the side yard where the code requires placement to the rear of the main mass of the principal structure pursuant to section 1206.03(f)(1), “Accessory Uses/Structures - Swimming Pools” of the City of Hudson Land Development Code.
