The City enters into an Agreement with the Summit County Public Defender's Commission annually for the defense of indigent defendants. Typically the City incurs minimal costs for the defense of indigents but is obligated to provide services if needed, pursuant to Chapter 120 of the Ohio Revised Code and Administrative Code 120-1-09. The billable rate for 2014 is $160 per case, and for the year to date, there have been no charges.
Purpose & Explanation
The Summit County Legal Defenders Office has requested approval of legislation authorizing contract services for the defense of indigents for cases opened during the period from January 1, 2015 through December 31, 2015, billable at a rate of $170 per case, which reflects an increased cost of $10 per case. The current rate of $160 per case has been in effect for the last eight years.
Timing Considerations
The administration would like to have the agreement signed and returned to Summit County in December, 2014.
