Brief Description:   The City has received a letter from Mr. Roberto Sorgi of American Fireworks asking whether the City would consider amending the Land Development Code.

Purpose & Explanation

The City received the attached letter from Mr. Roberto Sorgi, Owner/Sales Manager of American Fireworks, requesting that the City consider moving forward with a Land Development Code amendment to permit the American Fireworks facility to operate as a conditional use (as opposed to the facility’s current status as a legal nonconforming use).  For Council’s clarification, the letter from Mr. Sorgi is not a formal application to initiate an amendment to the City’s Land Development Code.

City Staff requests that Council review the letter from Mr. Sorgi and identify what action City Council would like to direct City Staff to take in response. 

For Council’s reference, City Staff advises that City Council could take one of two actions in response to the letter: (1) direct the Planning Commission to study whether the City should initiate an amendment to the Land Development Code consistent with Mr. Sorgi’s letter or (2) direct City Staff to take no action.

Suggested Action

Staff asks that City Council direct Staff on how to proceed.  If City Council decides to move forward with asking the Planning Commission to study the matter, then City Council should pass a motion authorizing the same.
