Purpose & Explanation
The Margaret Clark Morgan Foundation ("MCM") is currently under contract to purchase 53 First Street, 17 West Streetsboro Street, and 36 North Main Street (collectively, the "Merino Properties"). MCM, during the due diligence period of its effort to purchase the Merino Properties, discovered that the current access drive on the northerly side of the 36 North Main Street parcel crosses over a small strip of city-owned land (adjacent to Park Lane). Upon investigation, it was discovered that the previous owners of the Merino Properties never formally memorialized with the City the right to access the Merino Properties from Park Lane. Staff recommends that the City enter into a nonexclusive access agreement with the owners of 36 North Main Street to formally memorialize said relationship.
