A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INTO A PURCHASE AND SALE AGREEMENT WITH NORFOLK SOUTHERN RAILWAY COMPANY FOR THE PURCHASE OF APPROXIMATELY 10.77 ACRES LOCATED AT PARCEL NO. 30-04145 IN THE CITY OF HUDSON, OHIO, FOR PUBLIC PURPOSES.
Brief Description: The City Manager is requesting City Council authorize him to enter into an agreement for the Purchase of Property for future rails to trail project. (See the attached map.) The cost of the property is $510,000 for a portion of Summit County, Ohio parcel 30-04145, currently owned by Norfolk Southern Railway Company, located at 650 W. Peachtree Street NW, Atlanta, Georgia 30308, and an additional $30,000 for abandonment of the railroad, for a total cost of $540,000.

Purpose & Explanation
Authorizing the City Manager to enter into an agreement for the Purchase of abandoned railroad right-of-way in Hudson, Ohio. The cost of the property is $510,000 for the purchase price, including rail track removal and $30,000 for railroad abandonment services for a total of $540,000 for portion of Summit County, Ohio parcel 30-04145, currently owned by Norfolk Southern Railway Company, located at 650 W. Peachtree Street NW, Atlanta, Georgia 30308.
The abandonment fee covers the costs to formerly file notice with the Surface Transportation Board that Norfolk Southern will no longer be obligated to provide rail service along this portion of the Akron Industrial Track. While an internal group at NS will compile the information, outside counsel that specializes in STB matters will be hired to submit the filing.
