Purpose & Explanation
The 18 acre property at Parcel 3006677 was recently purchased by Eric Nye who resides at 3000 Pine Trails Circle, across the street from the subject property. Mr. Nye has submitted the attached letter indicating an interest in completing some selective clearing for an access path in the near term and in the future to clear approximately 3-5 acres of the 18 acre property for the planting or grapes and apples.
Removal of the reservation strip and establishment of an agricultural use will remove the practical ability to establish a subdivision extension in the future. Staff notes the surrounding subdivision is serviced by sanitary; however, public water is not available to the site further restricting the likelihood of development beyond limited agricultural.
Agriculture is a use by right within District 2. The limited growing of apples and vines may create minimal impact; however larger scale operations accessed from the interior of a subdivisions could create impacts to surrounding properties. The use establishment, including tree clearing/planting would be an administrative review process. Proposal of new principal buildings would be considered major development and would require a site plan review by the Planning Commission.
The City Council has the authority to consider the release of the reservation strip and to consider the proposed development anticipated. After introduction at a Council workshop, staff recommends issuing a courtesy notice to all property owners within 300 feet to inform them of the requested application prior to Council's formal consideration.
