Purpose & Explanation
Previously, the City Council passed Ordinance 25-91, which brought the City's criminal code in line with state law surrounding firearms. As a part of that legislation and as permitted by state law, the City adopted a policy that allowed the City's elected officials to carry a concealed firearm in certain City-owned buildings if they were legally qualified to do so and reported their plans in advance to the Chief of Police, Council President, and the Mayor. This policy was a discretionary policy decision.
This legislation will change the discretionary policy portion of the prior legislation. By appropriately limiting the possession of concealed handguns in City facilities, the City can help prevent any confusion regarding the identification of threats on scene, and law enforcement officials will be able to more effectively and appropriately respond to situations on City properties should an emergency threat arise.
