Title
AN ORDINANCE VACATING THE UNIMPROVED RIGHT-OF-WAY AT HUDSON CROSSING BUSINESS PARK; AND DECLARING AN EMERGENCY.
Executive Summary: The legislation would remove the unimproved right of way and deed the land to the adjoining property owners.
Body
Legislative History
Planning Commission reviewed this matter at its meeting on June 11, 2018 and recommended City Council approve the vacation of this right of way
Purpose & Explanation
Hudson Crossing Business Park was established in 2006. At that time a 2,000 linear foot public roadway was constructed with an additional 2,000 feet of unimproved right of way established to allow for possible extension of Hudson Crossing Parkway towards Boston Mills Road. The extension of the public street is no longer necessary as the street would impact significant high-quality wetlands, the northern acreage has been rezoned residential and developed as the Reserve at River Oaks, and the through access needs for emergency services are now met by the Chittenden Road improvements completed several years ago. The request has been submitted at this time as the property owner is seeking to develop the surrounding acreage.
Timing Considerations
Planning Commission recommended approval of the vacation on June 11, 2018. Emergency clause has been requested for action at the first reading on June 19, 2018 due to economic development. The developer is awaiting approval to commence construction of the project.
