23-166 adopted December 11, 2024 establishing the 12 month moratorium
Purpose & Explanation
The 12 month moratorium on accepting applications for marijuana related activities is set to expire on December 10, 2024. While the moratorium was in place, City Council adopted regulations applicable to such uses per 23-154 which establishes recreational marijuana facilities as conditional uses in District 9 with setback standards including a 500 ft setback to a residentially zoned parcel, school, or use of the same category. As the state regulations due allow individual municipalities to fully prohibit these uses, staff is seeking to notify Council of this and confirm if the moratorium should be allowed to expire, extended, or if a prohibition of such uses in desired.
Council briefly discussed this topic in August as part of the larger 2024 LDC Update discussions. There were some varied comment expressed at that time and Council President Foster noted the topic would require additional discussion.
The city does receive occasional inquiry from companies looking to site recreational marijuana facilities. With the expiration of the moratorium, staff does anticipate development applications for such uses may occur.
