Executive Summary:   The City enters into an Agreement with the Summit County Public Defender’s Commission annually for the defense of indigent defendants.

Legislative History

The City enters into an Agreement with the Summit County Public Defender’s Commission annually for the defense of indigent defendants.  Typically the City incurs minimal costs for the defense of indigents but is obligated to provide services if needed, pursuant to Chapter 120 of the Ohio Revised Code and Administrative Code 120-1-09.  For the year to date, two cases were billed at the 2014 rate of $160/case, and one case was billed at the current rate of $170/case.  A total of $490 has been paid to the Summit County Public Defender’s Commission during the current year.

Purpose & Explanation

The Summit County Legal Defenders Office has requested approval of legislation authorizing contract services for the defense of indigents for cases opened during the period from January 1, 2016 through December 31, 2016, billable at a rate of $170 per case, which reflects no increase over the current rate.

Timing Considerations

An emergency clause has been included, as the new agreement is effective January 1, 2016.
