Title
AN ORDINANCE CODIFYING THE RIGHT TO OPERATE A LOW-SPEED, UNDER-SPEED, UTILITY VEHICLE, OR MINI-TRUCK IN THE CITY OF HUDSON.
Brief Description: The City is interested in creating a regulatory scheme addressing vehicles, such as golf carts and UTVs, after recent changes to State Law.
Body
Legislative History
None.
Purpose & Explanation
Ohio Revised Code in Section 4511.214 regulates when someone may drive a low-speed, under-speed, utility vehicle, or mini-truck on a public road. A primary requirement is that the political subdivision has authorized such vehicles to travel on its roadways pursuant to Ohio Revised Code Section 4511.215.
This proposal would update the City’s Codified Ordinances in a manner which allows its citizens to continue driving their affected vehicles as they have been without running afoul of the Ohio Revised Code. This resolution would also clarify any confusion within the City among citizens and law enforcement regarding whether such vehicles may be operated on low-speed roadways.
Timing Considerations
The sooner this Ordinance is passed, the sooner the Codified Ordinances of the City can be updated in a manner that conforms with State Law. However, the City in the meantime, can continue to not cite individuals operating low speed vehicles who are otherwise conforming with the law until this Ordinance goes into effect and the City’s official policy with respect to these vehicles is clarified.
Fiscal Impact
None

Yes [if so, explain why]
