Purpose & Explanation
At the request of City Council members, staff are reviewing the City's applicable ordinances and permitting processes related to the operation of food trucks in residential neighborhoods.
Current regulations permit ice cream trucks to operate in residential neighborhoods as an exception to the general prohibition on mobile food vehicles operating within the public right-of-way. Temporary special events, such as block parties, may allow mobile food truck operations when authorized through the applicable permit process.
Additionally, CD and FD staff anticipate reviewing the existing regulations to identify potential updates for Council's consideration, including:
* Aligning the regulations with the most current Fire Code and using consistent terminology and definitions.
* Clarifying when mobile food trucks may operate in residential neighborhoods, including at private events such as block parties, graduation parties, weddings, and similar gatherings.
* Identifying any additional amendments needed to improve clarity, consistency, and enforcement of the regulations.
If staff determines that amendments are appropriate, recommendations will be presented to City Council for consideration in the Fall. If there are specific topics or regulations Council would like researched, staff can incorporate into the upcoming review.
For your reference, attached are the current codified ordinance and a comparison chart outlining applicable regulations in comparison to other cities.
