Resolution No. 13-108 (attached) was passed by City Council on October 16, 2013, authorizing the City Manager to terminate a current Lease Agreement with Lake Erie Golf Car Company and to enter into a new Agreement with Lake Erie Golf Car Company for the leasing of new golf cars at the Ellsworth Meadows Golf Club.
Purpose & Explanation
Following Council's authorization of Resolution No. 13-108, the City administration and City Solicitor learned that the golf carts were to be financed and owned by PNC Equipment Finance, LLC, and not by the Lake Erie Golf Car Company. As a result, the following two actions need to occur: 1.) repeal Resolution No. 13-108 and approve a new resolution authorizing a maintenance / repair agreement with the Lake Erie Golf Car Company; and 2.) approve a new resolution to execute a lease agreement with PNC Equipment Finance, LLC.
The attached legislation pertains to item 1.) above, thus seeking a resolution authorizing the city manager to terminate an existing rental/lease agreement and to enter into a new maintenance/repair agreement with Lake Erie Golf Cars, LLC; repealing Resolution No. 13-108; and declaring an emergency.
A separate piece of legislation (Resolution No. 13-141) will address item 2.) above.
