Purpose & Explanation

Level 3 Communications LLC has requested to license seven (7) HPP poles at the current pole license agreement amount of $5.00 per pole / per year.   Level 3 currently has two (2) ground leases with the City of Hudson near the railroad tracks at Hines Hill Road on the City parcel adjacent to the former Hudson Waste Water Treatment Plant.  These leases have associated structures and have been in place for several years.  A plan drawing has been attached for location reference.

Timing Considerations

Staff requests emergency legislation to allow prompt execution of the upgrades.

Suggested Action

Staff recommends City Council grant permission to the City Manager to enter into a utility pole license agreement and with Level 3 Communications LLC per the attached agreement and license rate.
