Purpose & Explanation
Presently the Ohio Revised Code requires that the sale of municipal owned land be accomplished only though a bidding process and that any sales contract be entered with the highest bidder. This removes the City's ability to best guide the sale and development of land. It forestalls potentially more appropriate and desired development of land through out the city.
Further, unlike the rules for the purchase of real estate, the rules surrounding the sale of City-owned land currently require that the City Council's discussions and deliberations all be held in public unless the discussion would reveal information that would create an unfair business or competitive advantage. This limitation is vague and prevents the City staff and City Council from discussing the very basic elements of any proposal, which are traditionally confidential, including appraisals, potential/alternative buyers and uses, financing, planned and unitneded consequences, legal concerns and other such matters.
This proposed ordinance will allow the City to continue the competitive bidding process but will also allow it the opportunity to pursue a different, direct sale with a purchaser if it is determined to be in the best interest of the City. The proposed ordinance will also make City Council's review and deliberations in connection with real estate uniform as between the potential purchase, lease and/or sale of land.
