Resolution No. 04-183 authorized the City Manager to enter into License Agreements for restaurant sidewalk seating following the opening of First and Main in 2004.
Resolution No. 2011-103 authorized the City Manager to enter into a site-specific License Agreement for restaurant sidewalk seating at 49 Village Way.
Resolution No. 2011-104 authorized the City Manager to enter into a site-specific License Agreement for restaurant sidewalk seating at 60 Village Way.
Purpose & Explanation
The City has received requests from Downtown 140 and Comida to establish outdoor dining areas within the public sidewalk area. Additional restaurants within the Downtown District may also wish to establish or expand their outdoor areas in the coming months. The Land Development Code permits outdoor dining as an accessory use per Section 1206.03(10). An administrative zoning certificate, including review by the Community Development and Engineering Departments, would be required for the proposed accessory use and associated improvements.
The attached License Agreement would require plan review/approval, maintenance of a five-foot walk zone (seven foot for N. Main Street), confirmation of State of Ohio Liquor Control compliance, insurance, indemnification, maintenance standards, and the ability to terminate.
