The Codified Ordinances indicate that the Nuisance Board was established in 1982 at Chapter 1442. Amendments to this section were made in 1998. The proposed sections to Chapter 1480 are new.
Purpose & Explanation
At the June 16 Council meeting City staff made a presentation concerning code enforcement and made several recommendations that would streamline the presently lengthy and expensive process required to handle code enforcement violations. Council was receptive to these recommendations. The attached ordinance would implement the recommendations and accomplish the following:
1. Authorize the City Manager or designee to determine a public nuisance and establish rules for making and exercising that determination.
2. Provide for appeals of a determination of a public nuisance to the Board of Zoning and Building Appeals.
3. Replace those sections of the International Property Maintenance Code with expanded language concerning tall grass and weeds. The maximum of height of grass and weeds is reduced from ten inches to eight inches.
4. Eliminate the Nuisance Board.
Timing Considerations
If Council conducts its first reading July 21, the second reading could be August 4 and the third reading and approval could be August 18.
